Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Crew mobile application and related services (collectively, the "Service") provided by Crew ("we," "us," or "our"). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian.
2. Your account
You are responsible for safeguarding your account credentials and for any activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We may suspend or terminate your account if you violate these Terms or the Community Guidelines.
3. Subscriptions and billing
Crew offers paid subscriptions through Apple In-App Purchase. By subscribing you authorize Apple to charge the payment method associated with your Apple ID.
- Auto-renewal. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the period ends.
- Cancellation. You can cancel any time from your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period; previously charged amounts are not refunded.
- Price changes. We may change subscription prices. Material changes will be communicated through the App Store and the app before they take effect.
- Refunds. Refund requests are handled by Apple under the App Store refund policy.
4. Acceptable use
When you use the Service you agree not to:
- Post content that is illegal, harassing, hateful, sexually explicit, or that infringes others' rights.
- Impersonate another person or misrepresent your affiliation with any person or entity.
- Attempt to access, probe, or scan the Service, its servers, or other users' data without authorization.
- Use automated systems (bots, scrapers, crawlers) to access the Service.
- Reverse engineer, decompile, or attempt to extract source code from the Service except where permitted by law.

5. User content
You retain ownership of the content you post (workouts, photos, messages, profile data). By posting, you grant Crew a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and display that content solely as needed to operate, improve, and promote the Service.
You represent that you have the rights necessary to post any content you upload and that the content does not violate these Terms.
6. Crew content and trademarks
The Service, including its software, design, branding, and copy, is owned by Crew and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes consistent with these Terms.
7. Health and fitness disclaimer
Crew is a fitness tracking and accountability app. The Service does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any new exercise, nutrition, or supplement program. Use of the Service is at your own risk.
8. Termination
You may delete your account at any time from the in-app settings. We may suspend or terminate your access to the Service at our discretion, including for violations of these Terms, fraud, abuse, or as required by law. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, dispute resolution) will continue to apply.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID CREW IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR USD 50.
11. Indemnification
You agree to defend, indemnify, and hold Crew harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.
12. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Crew is established, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in that jurisdiction for any dispute that is not subject to arbitration.

15. Partner Library Content
This section applies to any user who has been granted Partner status by Crew and who uploads, submits, or otherwise contributes video content to the in-app library feature ("Library Content"). By submitting Library Content, you agree to the terms in this section in addition to the rest of these Terms.
15.1 License to Crew
By submitting Library Content, you grant Crew a perpetual, worldwide, irrevocable, royalty-free, sublicensable, and transferable license to:
- host, store, transcode, reformat, compress, and back up the Library Content;
- publicly display, perform, stream, and distribute the Library Content within the Service and any successor products of Crew;
- create thumbnails, preview clips, excerpts, and derivative works from the Library Content for in-app navigation, search, recommendations, and promotional use across Crew-owned channels (including social media, email, paid advertising, and press materials);
- sublicense these rights to Crew's service providers (such as video hosting providers, content delivery networks, and analytics vendors) solely as needed to operate the Service.
This license survives termination of your Partner status and survives your account deletion, but only with respect to Library Content already submitted before termination. You may request that specific Library Content be retired through the in-app Help & Support screen.
15.2 Ownership
You retain ownership of all intellectual property rights in your Library Content, subject only to the license in Section 15.1.
15.3 Your warranties and representations
By submitting Library Content, you represent and warrant that:
- (a) Ownership / rights cleared. You own, or have obtained all necessary licenses, releases, consents, and permissions for, every element of the Library Content — including all video footage, audio recordings, music, voiceover, photographs, graphics, animations, on-screen text, and any third-party trademarks or copyrighted works that appear in the content.
- (b) Talent and likeness releases. Every identifiable person who appears in or whose voice is used in the Library Content has consented to being filmed/recorded and to Crew's use of their likeness and voice as described in Section 15.1. You can produce written evidence of these releases on request.
- (c) No infringement. The Library Content does not infringe any patent, copyright, trademark, trade secret, right of publicity, right of privacy, moral right, or other proprietary right of any third party.
- (d) No unlawful or harmful content. The Library Content does not violate any law, regulation, or court order; does not constitute defamation, harassment, threats, or incitement; and does not contain material that is obscene, sexually explicit, gratuitously violent, or otherwise harmful as determined by Crew in its reasonable discretion.
- (e) Health and safety claims. Any health, fitness, nutrition, medical, or psychological claims in the Library Content are made in good faith, are not knowingly false or misleading, and are appropriate for a general adult audience. You understand that Crew does not provide medical advice and that your Library Content does not represent professional medical advice from Crew.
- (f) Authority. You have the legal capacity and authority to grant the license in Section 15.1 and to make the representations in this Section 15.3.
15.4 Indemnification by Partner
In addition to the general indemnification in Section 11, you agree to indemnify, defend, and hold harmless Crew, its officers, directors, employees, agents, affiliates, successors, and assigns from any third-party claim, demand, action, loss, damage, liability, cost, or expense (including reasonable attorneys' fees) arising out of or related to:
- any Library Content you submit;
- any breach by you of the warranties in Section 15.3;
- any violation by you of applicable law in connection with the Library Content; or
- any claim that your Library Content infringes a third party's intellectual property, publicity, or privacy rights.
15.5 Compensation
Unless Crew has signed a separate written agreement with you that specifically addresses compensation for Library Content, you are not entitled to any monetary or in-kind compensation, royalty, share of revenue, or other payment for the license you grant under Section 15.1.
15.6 Retirement, removal, and termination
- You may request that specific Library Content be retired through the in-app Help & Support screen. Crew will retire the content within a reasonable period (typically 7 business days), but the license in Section 15.1 remains in effect for any continued use already in progress at the time of the request.
- Crew may, in its sole discretion, retire, remove, edit (for length or technical reasons), or refuse to publish any Library Content at any time, with or without notice, and with or without cause.
- Crew may terminate your Partner status at any time, with or without cause. Termination of Partner status does not automatically retire previously submitted Library Content; Crew may continue to display previously submitted content under the license in Section 15.1.
15.7 Moral rights waiver
To the maximum extent permitted by applicable law, you waive any moral rights, droit moral, or similar rights you have in the Library Content with respect to Crew's use of that content under Section 15.1.
16. Library Content viewing, reporting, and DMCA
This section applies to all users of the Service who view, watch, comment on, react to, share, or otherwise interact with Library Content (whether contributed by a Partner under Section 15 or by Crew itself).
16.1 Educational and informational purpose
Library Content is provided for educational and informational purposes only. Library Content is not medical, psychological, or professional advice. Consult a qualified professional before making decisions about your health, fitness, nutrition, mental health, or any other matter described in Library Content. Crew makes no representations about the accuracy, completeness, suitability, or results of any Library Content.
16.2 No publisher status
Crew hosts and distributes Library Content but does not author, endorse, or guarantee Partner-contributed Library Content. Views, opinions, claims, and statements in Partner-contributed Library Content are those of the contributing Partner, not of Crew. To the maximum extent permitted by law, Crew disclaims all liability for the content of, and any reliance you place on, Partner-contributed Library Content.
16.3 Reporting Library Content
You may report any Library Content you believe violates these Terms or applicable law by using the in-app report feature on the video detail screen. Report categories include spam, abuse, copyright infringement, misinformation, and other violations. Crew reviews reports on a best-effort basis, typically within 7 business days. Reports involving credible safety concerns or formal copyright notices are reviewed on an expedited basis. Repeated bad-faith reporting may result in suspension or termination of your account.
16.4 DMCA notices and copyright agent
Crew complies with the U.S. Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. If you believe Library Content infringes your copyright, send a written notice containing all of the following to Crew's designated copyright agent:
- A physical or electronic signature of the copyright owner or authorized representative.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the allegedly infringing Library Content, with enough detail (such as the video title, the URL or in-app path, and the date you viewed it) to allow Crew to find it.
- Your contact information, including address, phone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Send notices to Crew's designated agent through the in-app Help & Support screen. The full agent contact information (mailing address, phone, and email) is available on request and is registered with the U.S. Copyright Office in accordance with 17 U.S.C. § 512(c)(2). Misrepresentations in a DMCA notice may subject you to liability under 17 U.S.C. § 512(f).
16.5 Counter-notification
If your Library Content was removed in response to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notification through the in-app Help & Support screen. A valid counter-notification must contain all of the elements described in 17 U.S.C. § 512(g)(3).
16.6 Repeat infringer policy
Crew terminates the accounts of users (including Partners) who are determined, in Crew's reasonable discretion, to be repeat infringers of copyright.
16.7 Your conduct as a viewer
When interacting with Library Content (including in comments, reactions, shares, or reports), you agree:
- Not to post comments that are unlawful, defamatory, harassing, threatening, hateful, obscene, sexually explicit, or otherwise inappropriate.
- Not to impersonate any person or misrepresent your affiliation with any person or organization.
- Not to use any automated system to scrape, download, mirror, or redistribute Library Content outside the Service.
- Not to attempt to circumvent any technological measures used to protect Library Content (including signed playback URLs and access controls).
16.8 No warranty on Library Content availability
Library Content may be added, modified, restricted, or removed at any time. Crew does not guarantee that any particular Library Content will remain available for any minimum period and disclaims all warranties (express or implied) regarding the availability, accuracy, or fitness of Library Content for any purpose.
