Terms

These are the terms for using Crew. They are written to be read. By creating an account you agree to them.

Who can use Crew

You need to be 13 or older to use Crew. An account is made only after you agree to these terms and give your birth year, whichever way you sign up. Nutrition features are for people 18 and older. You are responsible for your account and for keeping your password to yourself.

Your content

What you log and post stays yours. You give Crew permission to store it and to show it to the people you chose to share it with, which is the only way the app can work. You can export or delete it at any time from Settings.

How to treat other people

A crew is a small group of people you invited. Do not harass, threaten or impersonate anyone, do not post hateful content or content that exposes or sexualises another person, and do not use Crew to break the law. Anyone can report a post, a person or a crew’s name and anyone can block a person; reports are read by a person. A Captain can remove any member from their crew.

Crew has zero tolerance for objectionable content and for abusive users. Content that breaks these rules is removed, and the account that posted it can be closed, the first time as well as any other.

Training and nutrition are your call

Crew is not a medical service. The plans, targets and estimates in the app are general information and not medical advice. Talk to a doctor before starting a training program or changing how you eat, especially if you have a health condition, and stop if something hurts. You train at your own risk.

The steps, blood pressure and blood glucose numbers Crew shows, whether read from Apple Health or logged by you, are for your own reference. They are not medical advice, a diagnosis or a medical device, and Crew does not judge them. Talk to your doctor about your numbers.

The supplement information behind a supplement’s “?” is quoted word for word from fact sheets published by the NIH Office of Dietary Supplements and the NIH National Center for Complementary and Integrative Health, with each sheet’s source and date named and linked. It is the NIH’s text, not Crew’s advice: Crew does not recommend any supplement, a dose or a use, and the NIH does not endorse Crew. Talk to your doctor before you start, stop or change a supplement.

The service

Crew is free to use, and nothing in it is for sale. It is a young product: features can change, and the service can be paused or ended. If Crew ever ends, you will get notice and time to export your data.

Crew is provided as it is, without warranties of any kind, to the fullest extent the law allows. To the fullest extent the law allows, Crew is not liable for indirect or consequential losses, or for injuries that result from training.

The app and Apple

Crew is licensed to you, not sold. The app itself is covered by Apple’s standard Licensed Application End User License Agreement — the terms Apple publishes at apple.com/legal/internet-services/itunes/dev/stdeula and applies to every app whose developer has not written its own. Crew has not written its own, so those are the terms that govern your copy of the app.

These terms sit alongside that agreement and cover the Crew service: your account, what you log and post, what Crew does with it, and how either side ends it. Where the two disagree about your right to use the app, Apple’s agreement wins. Apple is not a party to these terms and is not responsible for the Crew service.

Ending it

You can delete your account at any time in Settings, and that ends these terms for you. Crew can close an account that breaks these terms; a closed account cannot sign in again, and its email address stays taken.

Who runs Crew

Crew is provided by Maxwell Alexander Cuenca, an individual. Where these terms say Crew, they mean Maxwell Alexander Cuenca, who you can reach at support@trycrew.fit.

The law that applies

These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in King County, Washington. This doesn’t take away any rights you have under the consumer laws where you live.

Changes to these terms

If these terms change in a way that matters, Crew will say so in the app before the change takes effect. Using Crew after that means you accept the new terms.
